EDC meeting 4/30 cancelled - anyone know WHY?

    Maybe they have decided that all is right with Riverside and they don't need to meet. Or maybe they don't want to be asked about the TIF, and whewre they stand now that the Village has not done what they advocated? Whomever knows please post.

    That the EDC supports the use of a TIF in Riverside as Proposed with the following qualifications:

    i) The EDC encourages the Village Board of Trustees to revise the Redevelopment Plan to include language memorializing the position of the Trustees to not use the TIF increment for purposes of purchasing residential property through Eminent Domain, and

    ii) The EDC encourages the Village Board of Trustees to evaluate the inclusion of the Central School and Hauser Junior High School properties within the TIF boundary, and

    iii) The EDC encourages the TIF Boundary be reconsidered to include only portions of Swan Pond necessary to i) maintain the WPA wall and steps and ii) improve drainage from flooding, and

    iv) The EDC encourages the further development, clarification, and prioritization of the “menu of items— included in the Transit Oriented Development Plan. Furthermore, the EDC formally encourages the Village Board of Trustees to detail and prioritize the infrastructure costs described in the Redevelopment Plan, and furthermore, the EDC formally encourages the Village Board of Trustees to detail and prioritize the infrastructure costs described in the Redevelopment Plan...

    I have wondered this myself - now that the Board does not seem to want to follow most of the suggestions from the one commission which came out strongly in favor of the TIF, how do the members of the EDC feel?

    1. They are not going to memorialize "the postion of the Trustees to not use the TIF increment for purposes of purchasing residential property through Eminent Domain",
    2. I guess they did evaluate the inclusion of the schools, but it isn't working out. There have been comments made in this forum, though, which seemed to suggest that the schools would, in fact, be made whole. That doesn't seem to be working out either.
    3. I forgot, did the Swan Pond area get shrunk to include a smaller portion of it? I don't remember, but if not, there is another recommendation that was not taken.

    To anyone:
    I know the trustees have EDIT: not seemed responsive even to the EDC's recommendations, but I had a question on item 1

    Does memorializing mean the same thing as what I heard Catherine call 'certifying', which I understand means 'swearing'? I further understand that to go back on this thing which has been certified would require modifying the TIF document to allow such ED. I am not sure of the procedure that would need to be followed, but corbi328 had described the mechanism in at least two posts (see below).

    A couple of clarifications. Just because a property is on the properties of interest list does not mean that the Village will acquire that property or that it has to acquire it via ED. Also, to be fair and completely above board, there is one more clarification. Even if the property is not on the properties of interest list but is within the TIF boundaries, it could be acquired by the Village using eminent domain. What would be required is a material amendment to the TIF redevelopment Plan, which implies that the Village would have to re-initiate the whole process (i.e. hold public hearings, convene the joint review board etc... ). Obviously a very cumbersome process and one that the Village would probably want to avoid at all costs.

    Kim thanks for relaying that story. I do want to add some color to the last part of your post. Only the properties currently identified as possible targets for acquisition are at risk to be acquired during the life of the TIF. For additional properties to be acquired, this would constitute a major change in the draft redevelopment Plan and Project and would necessitate a restarting of the TIF process (i.e public meeting, public hearing, Joint Review Board, etc...). I guess in theory it could happen but in my mind it is highly unlikely as it would be very cumbersome and expensive.

    MikeT, in looking again at the TIF Act the other day, I noted it said that if there are less than 10 residential "units" to be displaced, that no housing impact study is required if the town certifies that no such displacement may/will occur. The language is not clear to me as to whether the certification is that no more than 10 units will be displaced, or that no units may/will be displaced.

    As to the EDC, I imagine they do not want to say anything further or do not have anything to say until they see what the board does. I certainly hope they have not been discussing the matter in private. I do see from their March minutes that they persist in calling their project the Art "Faire". Little wonder, then, that they see no problem with the VC.
