    I am sick at home so have been watching this on Channel 6.
    Something must be wrong with one of the mics.
    Every time Mr. Corbi speaks, there is no sound.

    Bantam - Fear not, help is on the way. I left the Zoning Code and the chicken soup with Tom, if he doesn't forget the bag. It says WalMart on it so he may not want to carry it. I made it with fresh chicken breasts and added onion, escarole, spinach and noodles so it has what you need. Get well soon. (Maybe add a little water when heating.)

    some anecdotes:

    *mr pilewski said that he has had experience with 75 TIFs, and NONE OF THEM EVER PAUSED for the voters as we did in Riverside.

    COMMENT: yes, Riverside is not well suited for TIFs which are better for big ol' dead malls.

    *mr Pilewski said that even fancier suburbs up north did not do a pause

    COMMENT: yes, Riverside is different; God Bless the Board / Admin for revealing the Good Riverside

    *I met a lady from Broadview who was taking this opportunity to find out about alterrnative forms of financing since Broadview has something like 3 TIFs and she is not too happy about those TIFs

    *she told me that while there was this fine exercise of democracy going on in Riverside tonight (her words), Broadview board was in the process of enacting another TIF without the full popular consent of the people.

    COMMENT: Our responsive government and our involved electorate is a model for other towns. Let's all keep up the good work to continue articulating our vision, keeping our eyes on the ball - on those things that are essential to Riverside and make it great, and let's try to fill some vacancies in the cbd and clean it up, and to do no harm.

    *the lady further said this: Broadview's experience with the TIFs was at first good - in a very industrialized area it helped resurrect some big facility that was vacant. This encouraged the local leaders to enact a couple more and those got out of control and so she is not happy with TIFs.

    *Mr Pilewski brought up the 4 recommendations that the EDC has proposed to the Board:
    1) put dist 96 into the TIF district
    2) clarify the TOD priorities
    3) Clarify Eminent Domain
    4) minimize green space encroachment

    COMMENT: for (3) ED, this is different than what I recalled the recommendation was. I was underthe impression, mostly by statements in this forum, and I thought also from my recollection from the papers, that there was a RENOUNCING of EMINENT DOMAIN for sfds; ED TO BE MEMORIALIZED (play TAPS for ED; poor ED is DEAD?). Only very recenly brother MikeS said he was in my corner.I guess he was not after all.

    I just looked up the Landmark and my recollection was correct; I guess it bested the President of the EDC's recollection. Why would he care about such a detail - at least compared to me? Maybe the reporting was wrong?

    The village board has repeatedly stated that it will not use eminent domain if and when it decides to acquire residential properties located within the TIF boundaries. Accordingly, the EDC formally encourages the Redevelopment Plan be revised to include language memorializing the position of the Trustees to not use the TIF increment for purposes of purchasing residential property through eminent domain.

    What does MEMORIALIZE mean?

    MikeT: #4, but not in that order, was remove as much green space from the TIF as possible. Leave in only those areas where there are plans to make improvements (seawall was specifically mentioned: they recommended trimming out the rest of Swan Pond.)

    Your recollection about the EDC's postion on ED is correct. However, I have been very surprised at the amount of comments that have been made in public about the desire and need to deal with 10,000 pound gorilla in town. I agree with those comments. A TIF would help in that regard as it can be used as a carrot or a bat. The question now becomes, how do we maintain full flexibility in dealing with property owners in town who do not live up to the standard of property ownership set by the rest of the town, while at the same time providing assurances to other TIF property owners who do live up to that standard that their properties will not be lost in a forcible sale?

    Perhaps then the boundaries should be adjusted to remove the propeties out of the TIF district that you do not intend to displace and only include the gorilla.

    Hi Corbi -

    We don't need a TIF to enforce our building codes and preservation codes, which impose penalties of up to $500 per day, per violation. Equitable legal theories (i.e. "demolition by neglect") can also be used to protect our local landmarks. With the latter, courts has the power to award the prevailing party with attorneys fees.

    The AG has 2 high-profile chancery suits pending against the gorilla. Timing is in the hands of the Village. But a TIF isn't necessary.

    Aberdeen,

    If the Village pursued action using a "demolition by neglect" rational, what would be the outcome if Riverside won the case? Would the defendant forfit the property to the Village? Would the defendant be forced to sell the property to the Village?

    Regarding some of your other suggestions, with all due respect I don't think you understand who we are dealing with. Fines and code violations would not even cause a blink of the eye, that is assuming we could even prove ownership of the building to be able to assess the fines.

    Aberdeen is absolutely correct. In their never ending quest to find reasons to justify the TIF, its advocates are now saying that it'll be used to solve the gorilla problem. I'm waiting for them to tell us how the TIF is going to give all of Riverside a paid vacation to Wonderland, where we'll have a private meeting with Alice, who, I am sure, is pro-TIF.
